1. Acceptance of Terms

By accessing or using Speakly at speaklyapp.co, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use Speakly.

These terms apply to all visitors, registered users, and anyone else who accesses or uses the service.

2. Description of Service

Speakly is an AI-powered language learning platform that helps people learn Spanish and English through structured lessons, vocabulary practice, and an AI tutor named Luna. The service is available via web browser at speaklyapp.co.

Speakly offers two tiers of service: a free tier and a paid premium subscription. The specific features available on each tier are described in Section 4 below and may be updated from time to time with notice.

3. Account Registration

• Accurate information — You must provide accurate, complete, and current information when creating an account and keep it up to date.
• Account security — You are responsible for keeping your password secure and for all activity that occurs under your account. Notify us immediately at hello@speaklyapp.co if you suspect unauthorised access.
• Age requirement — You must be at least 13 years old to create an account or use Speakly. By registering, you confirm that you meet this age requirement.
• One account per person — Each individual may maintain only one Speakly account. Creating multiple accounts to circumvent free tier limits is a violation of these terms.

4. Free and Premium Tiers

Speakly offers two service tiers. Features are subject to change with reasonable notice to users.

5. Payments and Billing

• Billing — Speakly Premium is billed at $4.99 per month. Payments are processed securely by Stripe. We do not store your credit card details.
• Cancellation — You may cancel your Premium subscription at any time from your account settings. After cancelling, your Premium access continues until the end of the current billing period. You will not be charged again.
• Refunds — We do not offer refunds for partial billing periods. If you cancel mid-month, you retain Premium access until the end of that month but will not receive a prorated refund.
• Price changes — We reserve the right to change subscription pricing. We will provide at least 30 days notice by email before any price increase takes effect. Continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

By using Speakly, you agree not to:

• Abuse, harass, or attempt to manipulate or deceive the AI tutor Luna in ways unrelated to language learning.
• Attempt to reverse engineer, scrape, copy, or redistribute any content or functionality from the platform.
• Share your account credentials with others or allow multiple people to use your account.
• Use Speakly for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the platform, its servers, or its databases.
• Interfere with or disrupt the integrity or performance of the service.

We reserve the right to suspend or permanently terminate any account that violates these acceptable use guidelines, without prior notice or refund.

7. AI-Generated Content

Speakly's AI tutor, Luna, is powered by Anthropic's Claude. All responses from Luna are generated by an AI model and are intended for educational purposes only.

• Speakly is not responsible for errors, inaccuracies, or omissions in AI-generated content. Language learning AI can make mistakes.
• AI tutoring through Speakly is not a substitute for instruction from a certified or professional language teacher.
• Conversations with Luna are processed by Anthropic in accordance with their own privacy and usage policies.

8. Intellectual Property

• Speakly content — All lesson content, branding, design, code, and other materials on the Speakly platform are owned by Speakly and protected by intellectual property laws.
• No redistribution — Lesson content, vocabulary, and exercises may not be copied, reproduced, or redistributed in any form without prior written permission.
• Your content — Chat messages and other content you generate while using Speakly remain yours. By using the service, you grant Speakly a limited license to store and process this content solely for the purpose of providing the service to you.

9. Disclaimer of Warranties

Speakly is provided "as is" and "as available" without warranties of any kind, either express or implied.

• We do not guarantee that use of Speakly will result in fluency or any specific learning outcome. Results depend on consistent individual effort.
• We do not warrant that the service will be uninterrupted, error-free, or free from viruses or harmful components.
• The service may occasionally be unavailable due to maintenance, updates, or circumstances outside our control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Speakly's total liability for any claims arising out of or related to these terms or your use of the service is limited to the total amount you paid to Speakly in the three months preceding the claim.

Speakly is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill, arising from your use of or inability to use the service.

11. Termination

• By you — You may delete your account at any time from the Settings page. Upon deletion, your account access is removed immediately.
• By Speakly — We may suspend or terminate accounts that violate these terms, with or without prior notice at our discretion.
• Data deletion — Upon account termination, your personal data will be permanently deleted within 30 days, except where retention is required by law (such as billing records).

12. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify all registered users by email at least 30 days before the new terms take effect.

Continued use of Speakly after updated terms take effect constitutes your acceptance of the revised terms. The "Last updated" date at the top of this page always reflects the most recent revision.
